PLEASE READ THE TERMS OF SERVICE CAREFULLY!

The following is the complete terms of service for all participating members of our affiliate program. All affiliates agree to abide by these terms while promoting HostMetro as an affiliate.

ENROLLING IN THE PROGRAM

In order to sign up for our affiliate account you must submit a completed application via the form on our website. We will instantly activate your affiliate account with the understanding that you will comply with all of the rules and regulations that are listed on this page. We may review affiliate accounts at a later time and reserve the right to reject the account if we determine that it is not following these guidelines.

COMMISSIONS

We will pay all valid and approved commissions a sum of $65.00 USD per referral. This rate is subject to change and any changes to the commission rate will be emailed to all affiliates no later than 30 days before the change.

COMMISSION PAYMENTS

All approved commissions will be paid to the affiliate in accordance with our payment cycle. All commissions will be pending for the first 30 days of the hosting account being active. After the account has been active for 30 days the commission will be approved. Commissions are paid on or around the 20th of each month. If the 20th falls on a weekend or holiday this may delay payment until the next business day.

REFERRAL RESTRICTIONS

We do not allow for incentive programs. Any form of incentive offered to visitors to receive referrals is forbidden unless we give written consent to do so. You may inquire about incentive programs by emailing us at affiliates@HostMetro.com.

We do not credit affiliate accounts for self referrals. Any account signed up or paid for by you, your household, or anyone within your organization will not earn an affiliate commission. Account information is recorded and monitored, and any information that matches or is similar between hosting account and affiliate account (First and last name, street address, phone number, IP address, etc.) will constitute a self-referral. We will only credit affiliate accounts for active referrals. An active account is a client who has a website and domain name that is pointed to a hosting account with us and has content uploaded to that account.

We welcome web designers/developers to sign up for our affiliate program. Due to the increasing attempted fraud with our (and other) online affiliate program we require that all customers sign up for their own hosting account using their own billing and payment information. Any affiliate who pays for a hosting account for a client, or uses their own payment information on a hosting account under another individual's name will not earn a commission for that referral.

Any referral of an existing customer or a customer who has had an account with us at any time in the past is not eligible for a commission.

We do not allow affiliates to promote our services by way of spam. This includes email spamming, forum spamming, cookie stuffing, or any other form of unacceptable link placing. If an account is found to be spamming we will immediately terminate the account and all commissions owed will be forfeit.

You may not represent or promote your affiliate link or website as HostMetro.com or the HostMetro.com website. This includes, but is not limited to, redirects of your affiliate link, URL redirects, ppc campaigns, or reproducing HostMetro.com website as your own.

Unless permitted by HostMetro, affiliates are not allowed to use the trademarked HostMetro name, misspellings, or variations, without prior express written permission. This includes, but is not limited to, domain names (e.g. HostMetroCoupons.com, HostMetroReviews.com), PPC keyword bidding (Google, Yahoo, Bing, or any other search engine advertisement program), or any other means of promoting (social media). Bidding on our trademark name plus another word (e.g. HostMetro Coupons) is prohibited.

YOUR WEBSITE

We do not in any way have responsibility for the content or maintenance of your website. Any code, banners, or any other means of advertising is solely the affiliate's responsibility.

Affiliates may promote any special advertisements that are currently displayed on our home page. Unique coupon codes are provided to affiliates for their sole use. Any referrals generated through your affiliate link using a coupon that is not associated with your account will not be credited to your affiliate account.

Coupons may be requested through the affiliate dashboard. Any coupon that has not been approved by a member of our affiliate staff can not be promoted. In the event that a coupon code is being promoted without the consent of HostMetro.com the affiliate account may be suspended until the promotions are removed.

MINIMUM PAYMENT

In order for an affiliate payment to be sent the balance of the account must be at least $100. Affiliate payments will stay in a pending status until the minimum balance has been earned by the affiliate. All pending referrals and pending sales must remain active and in good standing in order to remain eligible for payment. If at any time an account is cancelled or violates our terms of service, the referral and commission will no longer be valid. Pending commissions that are not paid after 12 months will be forfiet.

AGREEMENT TERMS

This agreement is in effect from the time the affiliate signs up for our program and ends when the affiliate account is terminated by either us or the affiliate. Both parties may cancel the affiliate relationship at any time, with or without cause, by giving notice of the termination. Once an account is terminated no additional commissions will be received for any referrals. If an affiliate account is terminated due to a violation of these terms then any pending commissions will be forfeit.

DISCLAIMER

All services provided by HostMetro are provided to the customer "as is" with no warranty or condition of any kind, either expressed or implied. HostMetro makes no representations or warranties that the services will (a) meet your requirements, or (b) the services will be uninterrupted, timely, secure, or error free. HostMetro will not be held liable for any damages or losses a customer's business may suffer. HostMetro is not responsible for any reimbursement for losses of income due to disruption of services.

INDEMNIFICATION

HostMetro customers agree to protect, defend, hold harmless, and indemnify HostMetro, any third party entity related to HostMetro (including, without limitation, third party vendors), and HostMetro executives, directors, officers, attorneys, managers, employees, consultants, contractors, agents, parent companies, subsidiaries, and affiliates, from and against any and all liabilities, losses, costs, judgments, damages, claims, or causes of actions, including, without limitation, any and all legal fees and expenses, arising out of or resulting in any from the customer's use of HostMetro services.

GOVERNING LAW AND SERVERABILITY

The Terms of Service, and any other agreement for HostMetro services, will be governed by and construed in accordance with the laws of the State of Illinois, USA without reference to its conflicts of laws principles. Any litigation or arbitration between a customer and HostMetro will take place in Illinois, and the customer will consent to personal jurisdiction and venue in that jurisdiction. If any provision or portion of the Terms of Service or any other HostMetro agreement is found by a court of competent jurisdiction to be unenforceable for any reason, the remainder of the Terms of Service or the agreement will continue in full force and effect.

THESE TERMS MAY CHANGE

We reserve the right to revise or change any portion of the terms at any time without advanced notice. Any changes will be effective upon posting the revisions to this website. The most current version of our terms will always be located on this page. Your continued use of our hosting following the posting of any changes will constitute your acceptance of said changes. If you do not agree to the changes made to the terms, please immediately terminate your account
